1. Who operates the service

BuySellTrade USA LLC operates BuySellTrade. Contact us at contact@buyselltrade.co or 11111 Biscayne Blvd, Miami, FL 33181. These Terms and our Marketplace Rules govern your use of the service. Our Privacy Notice explains how we handle personal information; acknowledging that notice is not consent to unrelated uses of your information.

2. Eligibility and agreement

The service is for individuals who are at least 18 years old and located in the United States. Availability may be limited by area, category or registration capacity. You must have legal capacity to enter this agreement. If you act for a business, you must have authority to bind it, and references to you include that business. Do not use the service if you do not agree to these Terms or if your participation is prohibited by law or a current account restriction.

3. Accounts

Provide accurate account information, use an email address you control and protect your access codes. Notify us promptly of suspected unauthorized access. You are responsible for activity you authorize; these Terms do not make you responsible for our own wrongdoing. Do not impersonate someone, sell access or evade restrictions.

Member accounts persist until closed or restricted. Temporary passes last seven days; an eligible 30-day recovery period can permit recovery of the same identity. Expiry does not delete your records or automatically renew listings. Email verification establishes control of an address, not identity, age, ownership or trustworthiness.

4. Our role and transactions

We provide tools for consumer-goods listings, community posts, discovery, communication and moderation. Buyers and sellers make their own transaction arrangements. We do not collect transaction payments, hold escrow, inspect goods, insure exchanges or provide a transaction refund service. Unless expressly stated for a particular transaction, we are not the buyer, seller or either party's agent.

You are responsible for your authority to offer goods, accurate descriptions, agreed delivery or collection, transaction payments and applicable taxes and legal obligations. Check goods and arrangements before completing an exchange. Moderation approval and reviews do not guarantee an item or participant. These descriptions do not exclude obligations applicable law places on BuySellTrade.

5. Listings and conduct

Follow the Marketplace Rules, including prohibited items, consumer-goods limits and the rules for designated Community sections. Do not submit unlawful, infringing, deceptive or unsafe offers; conceal material defects; harass others; manipulate reviews; send spam; collect others' personal information without authority; or interfere with security and access controls. Do not use the service to facilitate exploitation, fraud or violence. Category labels do not override these restrictions.

We grant you a limited, nonexclusive, nontransferable permission to use the service for its intended purposes while you comply with these Terms. Our branding and service software remain ours or our licensors'. This does not restrict rights that applicable law makes non-waivable.

6. Your content and permission to operate the service

You retain ownership of your content. You confirm that you have the rights needed to submit it and authorize the uses described here. You give BuySellTrade a nonexclusive, worldwide, royalty-free permission to host, store, reproduce, format, resize, compress, transmit and display your content only as reasonably needed to operate, secure and support the service and handle reports and legal obligations. Service providers may exercise this permission on our behalf for those purposes.

This permission does not make private messages public or authorize unrelated advertising use. Visibility follows the feature you use and the Privacy Notice. Removing content ends permission for new ordinary display, except for copies legitimately retained for shared conversations, security, disputes, legal requirements and backups as described in the Privacy Notice. Retained copies remain subject to those limited purposes. Copies independently made by other users are outside our direct control.

7. Moderation and reporting

We may review submissions and reports, remove or limit content, pause categories, suspend access or close accounts when reasonably necessary to enforce these Terms, address safety or legal concerns, or protect the service. We may act promptly without advance notice where notice would undermine those purposes; where appropriate, we will explain the action through the service or support.

Use the available report or appeal controls, or contact support for access problems or a disputed action. Appeals of eligible report decisions require a reviewer independent of the original decision. We do not promise that every item is reviewed continuously or that a concern will be resolved within a particular time. For immediate danger, contact emergency services rather than relying on a platform report.

8. Intellectual-property concerns

Do not upload material that infringes another person's rights. Send intellectual-property concerns to contact@buyselltrade.co with your contact information, the affected material's location, the rights involved and an explanation of your authority and concern. We may request information reasonably needed to evaluate and act on the report. A general complaint is not automatically a statutory copyright notice or counter-notice. 9. Availability and warranties

To the extent permitted by applicable law, the service is provided as available, without warranties of uninterrupted operation, error-free performance, merchantability, fitness for a particular purpose or noninfringement. We cannot guarantee that user content is accurate or that an exchange will be completed safely or successfully. We remain responsible for rights and obligations that cannot lawfully be excluded, and nothing here overrides an express commitment we make to you.

10. Liability

To the extent permitted by applicable law, BuySellTrade is not liable for indirect or consequential losses, including lost profits or business opportunities, arising from use of the service. This exclusion does not apply where such liability cannot lawfully be excluded, including liability for our fraud or willful misconduct. Nothing in these Terms waives non-waivable consumer rights or excuses our own obligations under applicable law.

11. Ending participation

You may stop using the service and submit an account closure or privacy request. A verified deletion request currently hides your account and listings and revokes sessions. Staff can review eligible profile and media cleanup; full erasure of all records is not currently implemented. Shared records, evidence and other retained information are addressed in the Privacy Notice. Closing an account does not cancel obligations already incurred in a transaction or remove rights either party already has.

12. Changes

We will identify each effective version and its effective date. We will give a prominent service notice or email about material changes and request renewed agreement before you continue participating under the updated Terms. Notice timing depends on the change and applicable requirements. Changes do not retroactively remove accrued rights or waive notice required by law. We will not treat a new privacy notice as permission for an incompatible use of previously collected information. You may stop using the service if you disagree.

13. Disputes and governing law

Please contact support first so we can try to resolve a concern; doing so is not a prerequisite to bringing a claim and does not suspend a legal filing deadline. Florida law and applicable United States federal law govern, except where mandatory law provides otherwise. Subject to non-waivable rights to bring a claim elsewhere, disputes may be brought in the state courts in Miami-Dade County, Florida, or the federal courts serving that county when they have jurisdiction. These Terms do not require arbitration, waive class proceedings or restrict eligible small-claims actions.

14. General provisions

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive future enforcement. These Terms and the Marketplace Rules are the agreement for the service, subject to any separately agreed written terms and rights that cannot be waived. Provisions concerning accrued obligations, limited retention of content, liability and disputes continue after participation ends to the extent necessary for their stated purposes. No provision gives a third party enforcement rights unless expressly stated.
